Executive summary

A registered trademark gives you the exclusive statutory right to your brand, name, logo and slogan, across India, in the classes you registered it in. India does recognise prior use, but asserting it means producing years of dated invoices and advertising and arguing the point. Registration converts that argument into a right. The government fee is ₹4,500 per class for an individual, startup or small enterprise filing online, and ₹9,000 for everyone else. Filings are handled by a bar-enrolled advocate holding an authorised attorney code for trademark practice, so the mark is filed by the person who would defend it. We act for clients across Haryana and the NCR, and registration under Udyam before filing reduces the government fee from ₹9,000 to ₹4,500 per class.

What is at stake

An Unregistered Mark Is A Claim You Have To Prove. A Registered One Is A Right You Assert.

India does recognise prior use, but proving it means producing years of dated invoices, advertising and sales records, and arguing it out. Registration converts that argument into a statutory right.

₹4,500

Government Fee, Per Class

For an individual, a DPIIT-recognised startup or a Udyam-registered small enterprise, filing online. ₹9,000 per class for everyone else.

Per class

Protection Does Not Spread

A registration covers only the classes you filed in. A clothing mark gives you nothing in cosmetics, however well known the brand becomes.

4 months

The Opposition Window

Once advertised in the Trade Marks Journal, any third party has four months to oppose. A mark that clears this stage unopposed is materially stronger.

18–36 mo

The Timeline, Uncontested

Application to certificate, assuming no objection and no opposition. Filing late does not just delay protection, it lets someone else file first.

Rebrand

The Real Cost Of Losing The Name

Packaging, signage, domains, marketing and goodwill, all rebuilt. This is almost always larger than the entire cost of registering at the outset.

10 years

And Then Renewal

Valid for ten years from the application date, renewable indefinitely. A missed renewal can remove protection you have held for a decade.

Who it is for

Who This Is For

Founders & Startups Protecting Their Brand

Registering their brand name and logo before a competitor does. India recognises prior use, but proving it means producing years of dated records and arguing it out, filing first is dramatically cheaper than establishing use later.

Established Businesses With Unregistered Marks

Who have been using a brand name or logo for years without registering it, and want to convert their common law rights into registered, enforceable protection.

Product Companies Launching New Lines

Who need trademark protection for new product lines, sub-brands, or marketing slogans before committing to packaging, advertising, and retail distribution.

Businesses That Have Discovered A Competitor With A Similar Name

Who need to file immediately to establish their own registration, and potentially oppose the competitor's application, before the window closes.

How It Works

  1. 01

    Class Identification & Search

DHULL identifies the correct Nice Classification(s) for your goods and services, conducts a preliminary search for conflicts, and confirms the filing strategy before any application is submitted.

  2. 02

    TM-A Application Filing

DHULL prepares and files the TM-A application on the IP India portal, covering word marks, logo marks, and slogans, with Vienna Codification for device marks and multi-class applications where required.

  3. 03

    Examination Through Certificate

DHULL tracks the application through examination, manages objection responses where raised, monitors the Advertisement period for third-party opposition, and procures the Registration Certificate.

Why Dhull

Multi-Class & Multi-Mark Strategy

Confidential Advisory

Your brand name, logo, and trademark strategy are handled with complete professional confidentiality at every stage.

Afterwards

After The Certificate

A trademark is a right you have to keep alive and keep watching. Registration is the start of that, not the end.

10 years

Renewal

Valid for ten years from the date of application, renewable indefinitely in further ten-year terms. We track the deadline and initiate renewal in advance.

5 years

Non-Use Vulnerability

A mark unused for five years and three months from registration can be removed on a rectification application by a third party.

®

Symbol Usage Changes

Use ™ while the application is pending. ® may only be used once the mark is actually registered, using it earlier is itself an offence.

Ongoing

Watch And Enforce

Registration does not police itself. New applications for similar marks are published continuously, and the four-month opposition window is the cheapest point to stop one.

Per class

Extending To New Categories

Launching into a new product category usually needs a fresh filing in the relevant class. Existing registrations do not stretch to cover it.

Assignable

Assignment And Licensing

A registered mark is property: it can be sold, licensed or used as security. An unregistered one is far harder to transact with.
