How it runs, and what decides each stage

Search
The mark is run against the IP India register for identical, phonetic and device similarity across the relevant classes, and against unregistered marks with prior use. You get a written opinion with a risk rating before any money goes to the Registry.

Classes and documents
Classes are fixed against what you sell. We collect the brand name or logo file, your identity and address proof, the Udyam or MSME certificate where it applies, and your signed Form TM-48.

TM-A filed
Filed online under the correct applicant category. Your rights run from this date, and the TM symbol can be used from here — which is why filing early is worth more than filing perfectly.

Examination
The Registry either accepts the mark or issues an Examination Report. What decides this is whether a conflicting mark exists and whether yours is distinctive rather than descriptive — not how long you wait.

Objection, if one comes
Each ground is answered with argument and evidence. Where the objection is descriptiveness, the evidence that counts is acquired distinctiveness through use, so the file we keep from day one matters here.

Advertisement and opposition
The mark is published in the Trade Marks Journal, and a third party has four months from that advertisement to oppose. Most marks pass this window without anything happening.

Registration
The certificate issues and the mark is yours for ten years, renewable. We hand over the renewal date at the same time.

The mark itself
The brand name as you will use it, or the logo file if you are registering a device mark. Registering a word and registering a logo are two different applications.
Applicant identity and address proof
PAN and Aadhaar for an individual or sole proprietor; incorporation documents and the authorised signatory's proof for a company or LLP.
Udyam or MSME certificate
Only if you want the ₹4,500 rate rather than ₹9,000. It is free to obtain and worth doing before filing, not after.
Signed Form TM-48
The power of attorney authorising an advocate to act for you at the Registry. We prepare it; you sign it.
Proof of prior use, where there is any
Dated invoices, packaging, advertising. Not required to file, but it is what wins a descriptiveness objection later, so it is worth gathering while it still exists.
